OPINION: Walang Pangangailangan para sa Pagbabago sa Saligang Batas: Isang Katwiran

Sa kasalukuyang panahon, marami ang naglalabasang panukala na naglalayong baguhin ang ating Saligang Batas. Maraming mga argumento ang inilalatag, mula sa pagpapalakas ng ekonomiya hanggang sa pagtugon sa mga pangangailangan ng ating lipunan. Gayunpaman, sa kabila ng mga ito, naniniwala ako na walang kinakailangang pagbabago sa ating Saligang Batas sa ngayon.

Ayon sa Article XVII, Seksyon 1 ng ating Saligang Batas, mayroong tatlong paraan para amyendahan o baguhin ang Konstitusyon: (1) sa pamamagitan ng isang Constitutional Convention, (2) sa pamamagitan ng inisyatiba ng Kongreso, at (3) sa pamamagitan ng inisyatiba ng mamamayan. Ito ay malinaw na itinakda ng batas, at ang pagbabagong ito ay hindi dapat gawing basta-basta.

Ang pagbabago sa Saligang Batas ay hindi lamang simpleng bagay. Ito ay isang proseso na nangangailangan ng maingat na pag-aaral, pagsusuri, at pagsangguni sa mga mamamayan. Hindi natin dapat itong isulong nang basta-basta lamang, lalo na't ang Saligang Batas ay siyang pundasyon ng ating bansa at dapat na sinusunod at iginagalang.

Mayroon ding mga pangunahing pangangailangan na dapat unahin ng ating pamahalaan. Sa kasalukuyang panahon, mas kinakailangan natin ang agarang aksyon at solusyon sa mga suliraning pang-ekonomiya, kalusugan, edukasyon, at seguridad. Ang panahon at pondo na magagamit sa isang Charter change ay maaaring mas mabuting gamitin para sa mga proyektong direktang nakakatulong sa mga mamamayan.

Napapanahon na sana na ang ating pamahalaan ay magtuon ng pansin sa mga tunay na pangangailangan ng mga Pilipino. Sa halip na mag-aksaya ng oras sa isang usaping hindi naman agad-agad na kailangan, mas mainam na maglaan tayo ng mga pondo at suporta sa mga programa at proyektong makakatulong sa pag-angat ng antas ng pamumuhay ng mga mamamayan.

Sa kasalukuyang panahon, kung saan tayo ay patuloy na hinaharap ng mga hamon at pagsubok, mahalagang pagtuunan natin ng pansin ang mga isyu at suliranin na may direktang epekto sa buhay ng bawat Pilipino. Hindi natin kailangang baguhin ang Saligang Batas upang makamtan ang pag-unlad at pagbabago na ating minimithi. Ang kailangan natin ay pagtutulungan, dedikasyon, at determinasyon na baguhin ang ating lipunan sa pamamagitan ng tamang pamamahala at pagkilos.

OPINION: Handa na Ba ang Pilipinas sa Diborsyo?

                                                 

Matagal nang usap-usapan ang usaping diborsyo sa Pilipinas. Sa gitna ng mga iba't ibang pananaw at opinyon, muling umiinit ang pag-uusap ukol dito. Ngunit sa kabila ng mga hamon at pagtutol, nararapat na suriin natin: handa na ba ang Pilipinas para sa diborsyo?

Ayon sa mga datos mula sa Philippine Statistics Authority, patuloy ang pagtaas ng bilang ng mga kasal na nauuwi sa paghihiwalay. Sa taong 2022 lamang, may kabuuang 59,190 na kasal ang nagtapos sa diborsyo. Ito ay nagpapakita ng katotohanang ang pangangailangan para sa isang maayos na batas ukol sa diborsyo ay patuloy na lumalaki.

Ngunit sa kasalukuyang sistema ng batas, ang Pilipinas ay isa sa dalawang bansa sa buong mundo na walang legal na diborsyo, ang isa ay Vatican City. Ito ay batay na rin sa probisyon ng ating Konstitusyon na nagpapahintulot lamang ng annulment.

Sa ilalim ng Family Code of the Philippines, ang annulment ay nagbibigay-daan lamang sa pagbasura ng kasal sa ilalim ng mga kondisyon tulad ng kakulangan ng pagkakaintindihan, pagkapilit, o kahit na hindi tamang estado ng pag-iisip ng isa sa mga nagpakasal. Ngunit sa maraming kaso, ang proseso ng annulment ay napapahaba at nagiging magastos para sa mga kalahok.

Nararapat nang isabatas ang diborsyo sa Pilipinas, sa paraang makatwiran at makatao. Ito ay hindi lamang tungkol sa pagbibigay ng kalayaan sa mga nagdudusa sa mga hindi maayos na pagsasama, kundi pati na rin sa pagprotekta sa kanilang karapatan bilang indibidwal.

Sa ilalim ng ating Saligang Batas, tanging Kongreso lamang ang may kapangyarihang magpasa ng mga batas ukol sa pamilya at kasal. Ito ay nakasaad sa Article VI, Section 28 ng ating Konstitusyon. Kung gayon, ito ang tamang panahon upang ang mga mambabatas ay pakinggan ang boses ng taumbayan at bigyang-daan ang pagtalakay ukol sa diborsyo.

Bilang isang lipunan, nararapat na ihanda natin ang mga kinakailangang mekanismo at suporta upang masiguro na ang diborsyo ay magiging isang proseso na makatarungan at hindi magdudulot ng karagdagang hirap sa mga sangkot. Kailangan din nating bigyang pansin ang pangangailangan ng mga batang apektado ng diborsyo upang masiguro ang kanilang kaligtasan at kinabukasan.

Sa pagpasa ng batas ukol sa diborsyo, hindi lamang natin binibigyan ng solusyon ang mga problemang pamilyar na hinaharap ng marami sa ating lipunan, ngunit pati na rin natin pinapahalagahan at pinoprotektahan ang mga karapatan at kalayaan ng bawat Pilipino. Handa na ba tayong harapin ang hamon na ito bilang isang bansa? Ang sagot ay nasa ating mga kamay.
